Those candidates who successfully complete and submit their Candidate Petitions and Candidate Agreements by the Committee’s posted deadline shall be considered formal candidates and shall have their names placed on the official ballot Write-in candidates must still abide by all the rules except for the submission of Candidate Petitions and Candidate Agreements. Disqualified candidates are not eligible to be write-in candidates. Write-in candidates are still required to submit an accurate spending report. 1. You must adhere to all University rules and policies, as well as outside municipal, state, and federal laws in spirit and detail. In addition to counting as campaign infractions, violations of these rules and policies will be referred to the proper authorities. 2. Violations of campaign rules campaigning done on your behalf. Any violation of the above stated rules or Committee of Election (CSE) rules by anyone will be investigated by the CSE and proper action will be taken. 3. Any campaigning that is slanderous or libelous is strictly prohibited. Additionally any statements that are personal attacks are inappropriate. The CSE shall use its best judgment in determining whether a statement should be deemed as a personal attack. The filing of a false complaint is defined as a personal attack and is subject to the same review by the CSE. 4. Dorm storming is against University policy therefore it is not permitted. You may speak at campus meetings if you adhere to the stated policies of the University, the organization that hosts you, and CSE guidelines. 5. a. Campaigning begins after you have submitted your petition. Campaigning will end at 11:59pm the night prior to the start of the election. Campaigning during unauthorized periods is grounds for an investigation by the CSE. b. Candidate Petitions are due in the CSE lock box by the date stated on the CSE website. 6. No spamming of public forums or e-mail lists is permitted. As a point of clarity, official club endorsements are not spam. An official club endorsement must be ratified by the club’s executive Committee and must pass with a majority vote. (signatures of officers) 7. The use of alcohol or other controlled substances to gather the favor of voters is prohibited. 8. Candidate Forms: Candidate Agreements, Candidate Spending Reports, and Candidate Petitions (100 signatures required for class elections, 300 for school wide elections) must be handed into the CSE on time in accordance with the instructions posted on the CSE website. Back to Top There is a spending limit of $100. Each poster is assumed to cost $0.07 and each color copy is assumed to cost $0.25. Advertisement rates will be verified by the relevant publications. Spending reports will be due at the close of the voting period and should be placed in the CSE box near the Mattin Center mailboxes. Spending reports will not be accepted by any other method. If you discover any violation of a rule you must contact the Committee of Elections. Send an e-mail to stuco@jhu.edu If you have any questions about a campaign method err on the side of caution, email stuco@jhu.edu before you perform a questionable action. If a complaint of a suspected campaign violation is brought before the Committee of Elections, the Committee will notify all relevant parties within 48 hours and determine whether a violation has occurred. If the Committee determines that a violation has occurred, an appropriate consequence will be determined. Depending on the severity of the violation, such consequences could include a warning, a ban on campaigning, disqualification from the election, or to bar a candidate from running in any other CSE run election in the future. A first violation may result in disqualification. All complaints should be reported to the CSE within 12 hours of the alleged violation and must be submitted to the CSE within 12 hours of the close of the election. If the Committee has determined that a violation has occurred, a consequence will be determined. The CSE will, when possible, make decisions based on past precedent, but reserves the right for any decision to be made. Additionally, the CSE reserves the right to turn any violation over to the Conduct Board if the Committee feels that such an action is warranted. All decisions made by the Committee are separate from any other University entities, and decisions made by other entities will have no bearing upon decisions made by the CSE, with the exception of the Appeals Panel. Back to Top 1. A flier is considered to be any paper campaign material with you name on it. Posters may be no larger than 8.5” x 11”. 2. A banner is defined to be any advertisement for a candidate that is larger than 8.5” x 11”. 3. Posting of fliers and banners must adhere to University policies. 4. It is acceptable for fliers to be distributed in outdoor areas of the campus provided that it does not disturb or harass any other students or events that may be in the area. Additionally, the area must be cleared of any debris that may result from the distribution. 5. Banners and their placement require Residential Life, Plant Operations, and CSE Chair approval. Banners may not monopolize public space. A banner is defined to be any advertisement for a candidate that is larger than 8.5” x 11”. 6. Posting of fliers is limited to one per candidate per bulletin board. 7. It is acceptable to post on dormitory doors only with the permission of the room’s residents. 8. Posting of fliers should be performed without damage to University property. As a rule, tape may not be placed on any wooden or glass portion of a door or any painted surfaces, with the exception of Gilman Hall. 9. You may not hand out posters door to door. 10. You may not slip posters under any doors. 11. You may not tear, remove, vandalize, or poster over any other candidate’s or group’s unexpired poster. All protests concerning elections or referenda must be submitted in writing to the Committee of Elections within twelve hours of the protested action. It is the responsibility of the person submitting the protest to provide all relevant data to support their claim of protest at the time of the submission of the claim. When a protest is submitted, the Committee shall decide the issue by a majority vote within 48 hours of receipt of the protest. All protests shall be heard by the Committee only once, unless the Committee by majority vote chooses to revisit the issue. The Committee will only review information provided with the protest at the time the protest is submitted. Later submissions to support the claim may be denied review. Appeals of decisions by the Committee of Elections may be made in writing to an appeals panel within 24 hours of the announcement of the Committees decision on a protest or rule violation. In the case of a rule violation, the appeal can only be made by the party that was investigated by the CSE. The Appeals Panel will consist of a the Presisdent of the Student Council, the Director of Student Involvement, and the Chair of the CSE. The Appeals Panel reserves the right to refuse to hear an appeal. Members of the appeals panel must: a. not be party to the dispute b. not have any questionable conflict of interest.
Hearings of the appeals panel must include the presence of the appellant as well as the Committee of Elections chairpersons, and such hearings will be chaired by the Director of Student involvement. The deliberation of the decision regarding an appeal is considered a closed discussion and will only include the three members of the appeals panel. This panel is authorized to interview all relevant parties in the conflict. A majority vote of the appeals panel is necessary to overturn decisions made by the Committee of Elections. Decisions of the appeals panel are final and may not be appealed. Back to Top |
